Terms & Conditions

Any orders placed with Indigo Cloud are subject to the following Terms and Conditions.

Contract:

Where there has been a deposit paid for work to commence it will be understood that Indigo Cloud will be paid in full within 14 days of completion of work.
If final settlement is not settled within this timeframe Indigo Cloud will issue a 7 day reminder on any outstanding bill. If no payment has been received after this date Indigo Cloud reserve the right to:

  • Take legal advice
  • Withdraw any work completed for the client that’s been uploaded to the Internet
  • Suspend the site & any associated email accounts.

Payment Terms:

Payment can be made using Cheque, Cash or Credit/Debit Card. Indigo Cloud uses PayPal to process credit/debit card payments and all card transactions will need to be processed through their website.

Cancellation:

Any client who wishes to cancel an order prior to it’s completion will not be entitled to a refund of their deposit. If a client wishes to cancel their site after the initial set up, they may do so by providing 30 days written notice. At the end of the 30 day period the site and sub-domain will be deleted from Indigo Cloud. We will provide both the theme and database files to any client who wishes to transfer their site to their own host, however an administration charge of £25 will be made to cover our costs. Indigo Cloud will not be able to provide technical support on the theme or database files.

Domain Names:

Any domain names that are to be used with Indigo Cloud will need to have their ‘A Records’ set to our IP address. In order to configure Google Apps for your email the MX records for the domain will need to be changed. Any domains registered on a clients behalf will be registered in the name of Indigo Cloud with fasthosts.co.uk. In the event of the client cancelling their service with Indigo Cloud a £10 administration fee will be charged to transfer the domain into the clients name.

Copyright:

Clients MUST have consent or authority to use any reference or image regardless of it’s source. Material taken from other publications (newspapers, magazines, brochures, leaflets, directories etc.) can be and usually is copyrighted to the publisher, designer or photographer. This dictates that these images/photographs cannot be used or reproduced in whole or part whatsoever. This can be confirmed by the appearance of the © copyright logo/mark. This copyrights all material within that publication. The © copyright logo/mark can also be present on individual entries/pages within a publication. Although it cannot be guaranteed that publications without this symbol aren’t copyrighted, therefore aren’t safe to use. The authority to use any image or reference must be sought from the client or original source and annotated by letter.

Search Engine Optimisation:

Unless stated on this website Indigo Cloud are not responsible for the clients continuous website promotion. Indigo Cloud will submit their clients website and put in relevant meta tags, keywords and an appropriate description of their clients website, but there is NO guarantee when the website will be listed because once Indigo Cloud has submitted your domain. It’s up to Google, Yahoo and MSN to do the rest. Indigo Cloud will do the very best it can to achieve a high position for their clients website on the search engines mentioned. Where appropriate all clients will have their details submitted to Google Maps to improve their ranking in location based search results.

Adult Material:

Indigo Cloud will not print or upload to our website any indecent images or words containing of an explicit nature. Any clients found to be uploading inappropriate material themselves will have their service suspended or cancelled. In the event of your site being removed from Indigo Cloud for indecent or explicit content no refund will be given.

Client’s Responsibility:

It is the responsibility of the client to make sure any work completed by Indigo Cloud is correct before going to print or being uploaded to the Internet. It is also the clients responsibility that any associations that the client belongs to are up to date and legitimate. Indigo Cloud are not responsible for any errors or content on pages that have been generated by the client.

Advertising:

Clients opting for the Stratus or Nimbus package will have adverts served on their site. These adverts will be carefully selected by our developers to ensure that the advertisers are not in direct competition with the site owner. Indigo Cloud are a member of the Affiliate Window scheme and will place no more than one banner ad (of any size) on each page. Indigo Cloud will never use Google Ads as we are unable to control which advertisers will be displayed. If you are unhappy with the adverts shown on your site please contact us and we will happily review them.

Software:

Indigo Cloud is powered by WordPress MU, an open source content management system. This software is provided free of charge and is openly available to all. Indigo Cloud do not charge for the use of the WordPress MU software or any of the themes that are used. All charges made by Indigo Cloud are to cover our time and costs in producing, publishing and hosting your site.

Themes:

Any WordPress Themes used on this site are open source and have been approved for commercial use. Indigo Cloud does not charge for the use of these themes. Any charges made for customising themes are to cover our time and costs to modify a theme to suit your needs. Where appropriate, donations are made to the original developer of the theme to enable them to continue to develop the theme.

Site Availability:

Indigo Cloud’s host offers a 99.9% uptime guarantee. This means that your site should never be unavailable, however, technical problems do occur and some downtime will be inevitable. As Indigo Cloud are not charging for hosting, no refunds will be made for any time that your site is unavailable.

By agreeing to these terms and conditions your statutory rights are not affected.
